Entitlements of al Qaeda terrorists to habeas corpus are rooted in congressional statutes, not the U.S. constitution (and even that is a contested gray area). However, even granting that your argument has merit, congress enacted the Detainee Treatment Act quite a while back, that gives detainees plenty of opportunity to contest their confinement.
